Informatie over gegevensbescherming bij Dentsply Sirona Dentsply Sirona verwerkt uw persoonsgegevens met als belangrijkste doel het beheren van communicatie en zakelijke relaties. Dentsply Sirona zal uw persoonsgegevens alleen verwerken in overeenstemming met de toepasselijke wetgeving. De wettelijke grondslag voor ons voor het verwerken van uw persoonsgegevens is dat verwerking daarvan in ons (legitiem) gerechtvaardigd belang is teneinde ons bedrijf te kunnen laten opereren en te promoten voor de uitvoering van een overeenkomst.

Bent u een patiënt? Dan is de wettelijke basis voor de verwerking van uw aankoopgerelateerde gegevens uw toestemming. Dentsply Sirona is een wereldwijde organisatie en dus kunnen de gegevens worden overgedragen aan andere eenheden binnen de groep of aan gecontracteerde servicepartners, buiten de Europese Economische Regio.

SureSmile, eigenaar van het bestelsysteem voor SureSmile-producten (het ‘productbestelsysteem’), erkent het belang van bescherming van uw privacy en ons privacybeleid is zo ingericht dat het u ondersteunt bij het inzicht krijgen in de manier waarop uw persoonsgegevens door SureSmile worden verzameld, bewaard, gebruikt, beschermd en bewaakt.

Bestellingen van SureSmile-producten (de ‘producten’) vinden volledig online plaats, door middel van het productbestelsysteem.

In het geval van verschillen tussen de Engelse versie van dit privacybeleid en andere taalversies ervan, geldt in alle gevallen de Engelse versie.

1. Omvang van het beleid en wie de verwerkingsverantwoordelijke is

Dit privacybeleid (‘privacybeleid’) van SureSmile heeft betrekking op het gebruik van het productbestelsysteem van SureSmile door u (de ‘gebruiker’) voor het bestellen van producten, waaronder mogelijk hiermee samenhangende producten en diensten die eveneens via het productbestelsysteem verkrijgbaar zijn (samen de ‘diensten’ genoemd).

Het productbestelsysteem wordt door de Dentsply Sirona-groep, een entiteit die optreedt als de verkoper, geëxploiteerd volgens de algemene voorwaarden waarmee u heeft ingestemd bij het verkrijgen van een licentie voor de SureSmile-software en/of het plaatsen van een bestelling voor SureSmile-producten (‘SureSmile’). SureSmile is de enige verwerkingsverantwoordelijke van alle persoonsgegevens binnen het productbestelsysteem. Naar SureSmile wordt overal in dit privacybeleid verwezen onder die naam of onder de titel van verwerkingsverantwoordelijke.

Ten aanzien van de persoonsgegevens van patiënten die door de gebruiker worden gebruikt bij het onafhankelijk uitvoeren van de planning in het productbestelsysteem, zijn SureSmile en de gebruiker gezamenlijk de verwerkingsverantwoordelijken.

2. Wettelijke basis voor de verwerking

Voor de afhandeling van de bestelling en het geven van voldoende ondersteuning voor uitvoering van de diensten, verwerkt SureSmile de persoonsgegevens (met uitsluiting van bijzondere persoonsgegevenscategorieën) op de wettelijke basis van het legitiem belang, in overeenstemming met artikel 6.1 (f) van verordening (EU) 2016/679 (de ‘AVG’).

De wettelijke basis voor het versturen van nieuwsbrieven en informatie over de diensten per e-mail is toestemming, artikel 6.1 (a) van de AVG.

Ten aanzien van bijzondere persoonsgegevenscategorieën, is de wettelijke basis de uitvoering van een overeenkomst, artikel 6.1 (b) van de AVG, in combinatie met de verwerking van bijzondere persoonsgegevenscategorieën, artikel 9.2 (i) van de AVG.

Het is de verantwoordelijkheid van de gebruiker, zoals is vastgelegd in de gebruiksvoorwaarden, om de patiënt op de hoogte te stellen in overeenstemming met de vereisten van de toepasselijke gegevensbeschermingswetgeving ten aanzien van het bekendmaken van persoonsgegevens aan SureSmile, om SureSmile zo in staat te stellen om de persoonsgegevens te verwerken voor de levering van de diensten. De melding dient bovendien alle relevante informatie te omvatten die noodzakelijk is op grond van artikel 13 van de AVG.

Daarnaast mag SureSmile bij het verkrijgen van geldige toestemming van de patiënt bijzondere persoonsgegevenscategorieën op een niet-identificeerbare (gepseudonymiseerde) manier verwerken voor doeleinden als wetenschappelijk of ander onderzoek of ten behoeve van productontwikkeling en marketing. In dit geval is de wettelijke basis legitiem belang, artikel 6.1 (f) van de AVG, in combinatie met artikel 9.2 (j) en artikel 89.1 van de AVG. Het is de verantwoordelijkheid van de gebruiker, zoals is vastgelegd in de gebruiksvoorwaarden, om geldige toestemming te krijgen van de patiënt, in overeenstemming met de vereisten van de toepasselijke gegevensbeschermingswetgeving ten aanzien van het bekendmaken van persoonsgegevens aan SureSmile, om SureSmile zo in staat te stellen om de persoonsgegevens te verwerken ten behoeve van wetenschappelijk onderzoek. SureSmile heeft passende organisatorische maatregelen en IT-beschermingsmaatregelen geïmplementeerd om te zorgen dat persoonsgegevens niet opnieuw identificeerbaar zijn.

In het geval van marketing via e-mail, waarbij de verwerking van persoonsgegevens is gebaseerd op toestemming, heeft u op ieder moment het recht uw toestemming in te trekken. Neem daarvoor alstublieft contact op met SureSmile (zie onderstaande contactinformatie). U kunt zich bovendien op ieder moment afmelden voor het ontvangen van informatie over onze producten en diensten.

3. Verzamelde informatie

3.1 Persoonsgegevens

SureSmile verzamelt persoonsgegevens van de gebruiker door het gebruik van online-formulieren en op ieder moment dat u ons uw gegevens stuurt per e-mail. Wij verzamelen bovendien informatie over uw transacties, waaronder gegevens over de betaalkaarten die u gebruikt.

Als u zich aanmeldt en uw klantenaccount aanmaakt via onze diensten, krijgt u de vraag om uw persoonsgegevens af te staan, waaronder uw naam, factuuradres, telefoonnummer en e-mailadres. Deze gegevens worden door ons bewaard. Wij verzamelen mogelijk ook persoonsgegevens over u als u met ons correspondeert, bijvoorbeeld als u ons berichten stuurt per e-mail, brieven stuurt of op andere manieren informeert naar de diensten.

3.2 Bijzondere persoonsgegevenscategorieën/gevoelige gegevens

Om de diensten te kunnen uitvoeren, vraagt SureSmile u om patiëntspecifieke scans toe te sturen en andere bijzondere details en specifieke, aan de behandeling gerelateerde gegevens, die wij zullen verwerken in overeenstemming met de AVG.

3.3 Niet-persoonlijk identificeerbare informatie

Als u gebruik maakt van de diensten kunnen we ook bepaalde niet-persoonlijk identificeerbare informatie verzamelen, die betrekking heeft op de manier waarop u zich toegang verschaft tot de diensten. Die informatie omvat bijvoorbeeld uw type browser en de versie daarvan, uw internetaanbieder en eventuele zoekmachines die u heeft gebruikt om de diensten te vinden.

Daarnaast verzamelt SureSmile ook bepaalde navigatie-informatie over u, bijvoorbeeld over waar u zich binnen de diensten beweegt. SureSmile zal zich in redelijkheid inspannen om het buitensporig of irrelevant verzamelen van gegevens te voorkomen.

4. Hoe de persoonsgegevens zullen worden gebruikt/doel van de gegevensverwerking

SureSmile verwerkt persoonsgegevens ten behoeve van de exploitatie en de verbetering van de diensten en verdere daaraan gekoppelde diensten, onze dienstverlening zelf en de personalisering daarvan, de afhandeling van uw vragen en verzoeken, de levering van producten, de verwerking van bestellingen en het beheren van accounts, de serviceverlening aan klanten, het beheren van klantendossiers en verder tevens om u in staat in te stellen gebruik te maken van de interactieve functies van de diensten, u nieuwsbrieven en informatie over producten, diensten en aanbiedingen te kunnen sturen en om met u te communiceren. Als er geldige toestemming van de patiënt is verkregen, mogen de persoonsgegevens ook worden gebruikt voor het uitvoeren van wetenschappelijk of ander onderzoek of voor productontwikkeling en marketing.

SureSmile gebruikt de niet-persoonlijk identificeerbare informatie voor het vaststellen van eventuele problemen met onze server, het verlenen van de diensten en het samenstellen van brede statistische gegevens. De door ons verzamelde navigatie-informatie stelt ons in staat om te bepalen welke onderdelen van de diensten het vaakst worden bezocht en helpt ons om de diensten aan te passen aan de behoeften en belangen van onze online-bezoekers. Daarnaast kunnen deze trackinggegevens worden gebruikt om de informatie die u via onze diensten krijgt aangeboden aan te passen aan uw vroegere gebruik van de diensten en aan uw belangstelling in bepaalde onderwerpen.

5. Bewaren van gegevens

Als u ons uw persoonsgegevens doorgeeft, bewaren wij die gegevens en worden ze door ons, of door een derde partij die namens ons handelt, opgeslagen voor het doel van de dienstverlening of voor de verstrekking van de informatie die u heeft opgevraagd. Uw persoonsgegevens worden door ons opgeslagen voor de duur die nodig is om volledig tegemoet te kunnen komen aan alle verplichtingen en verbintenissen ten opzichte van u of andere verplichtingen die SureSmile worden opgelegd en zullen daarna worden gewist.

6. Bekendmaking van persoonsgegevens

SureSmile zal uw persoonsgegevens niet delen met, overdragen aan of op andere manieren bekendmaken aan anderen, zonder dat u daarvoor toestemming heeft gegeven, behalve voor de dienstverlening aan u of voor het verstrekken van de door u opgevraagde informatie, tenzij bekendmaking op grond van wet- of regelgeving vereist is.

Uw persoonsgegevens kunnen worden overdragen aan derde partijen die zich buiten de Europese Economische Ruimte (EER) bevinden en uw persoonsgegevens opslaan en verwerken om SureSmile in staat te stellen de diensten te verlenen.

SureSmile heeft passende overeenkomsten gesloten met de verwerkers van gegevens, om te zorgen dat zij passende organisatorische maatregelen en IT-beschermingsmaatregelen geïmplementeerd hebben om uw persoonsgegevens te beschermen tegen ongeoorloofde toegang.

De diensten kunnen links naar andere websites bevatten. SureSmile is niet verantwoordelijk voor de privacypraktijken of de inhoud van dergelijke websites. 8. Gebruik van cookies

2. DENTSPLY SIRONA needs to process Personal Data about you for a variety of purposes.  DENTSPLY SIRONA will only process your Personal Data in accordance with applicable law for the following purposes:

a) Manage our business relationship with you, for example: (i) process your transaction; (ii) manage and maintain your account with us; (iii) respond to your questions and comments and provide customer support; (iv) set up a Dentsply Sirona loyalty program account; (v) allocate a Territory Sales Manager or equivalent to be your dedicated account manager

EU Data protection law requires us to have a legal basis before processing any Personal Data about you.  The legal basis’ for us processing your Personal Data for the above purposes may be because: (i) you have provided your consent; (ii) it is necessary for the performance of a contract with you; (iii) the processing is necessary for our compliance with a legal obligation; or (iv) the processing is in our legitimate interests of operating and promoting our business. 

4. To the extent provided by applicable law, you may withdraw any consent you previously provided to us, or object at any time on legitimate grounds, to the processing of your Personal Data. In some circumstances, withdrawing your consent to DENTSPLY SIRONA’s use or disclosure of your Personal Data will mean that you cannot take advantage of certain DENTSPLY SIRONA products or services.

5. We intend to keep your Personal Data confidential, in compliance with our legal obligations. We do not sell, rent, trade or otherwise disclose Personal Data to third parties, other than as described in this Privacy Statement, for the purposes described above, or as we disclose to you at the time the information is collected. We may disclose or transfer your Personal Data to a third party in countries outside the country in which it was originally collected for further processing in accordance with the purposes set out in section 1 above, in particular your Personal Data may be transferred throughout the DENTSPLY SIRONA group.  In these circumstances we will, as required by applicable law, ensure that your privacy rights are adequately protected by organizational, technical, contractual and/or other lawful means.

8. Your Personal Data will be retained for the duration of our business relationship and for a period of time thereafter as required by applicable local law or where we have a legitimate and lawful purpose.

9. DENTSPLY SIRONA will retain applications of unsuccessful candidates for a reasonable period after the application process to enable us to contact you if another suitable position arises or to comply with our legal obligations.

10. Data protection laws often provide individuals with numerous rights, including the right to: access, rectify, erase, restrict and object to the processing of, their Personal Data.  Individuals may also have the right to lodge a complaint with the local data protection authority if they believe that their Personal Data is not being processed in accordance with applicable data protection law. If you would like to exercise any of these rights, please contact the Dentsply Sirona Privacy Office at EUprivacyoffice@dentsplysirona.com.  To assist us in responding to such requests in a timely fashion, please include the phrase “Privacy Rights Request” in the title of your message.

11. Data subjects may, where permitted by applicable law, request copies of their Personal Data. This is known as a subject access request or SAR.

12. If you would like to make a SAR, i.e. a request for copies of the Personal Data we hold about you, and you are in a jurisdiction where applicable law grants you such rights, you may do so by writing to the Data Protection Contact whose details are provided above. The request should make clear that a SAR is being made.  We may ask you to provide evidence of your identity if it is not clear.

13. Responding to a SAR can be a time consuming exercise. DENTSPLY SIRONA may be able to get the information that you require more quickly if you are as specific as possible in your request. E.g., “I would like a copy of my Personal data contained in my website member account file” or if you would like a copy of a particular document it would be helpful if the document is described carefully, including the title, creation date, author and likely place of storage.  This will help us to respond to your SAR as quickly as possible. You may be asked for further details to assist us if insufficient information is provided.

14. This website may make chat rooms, careers, message boards, and/or news groups available to its users at various times. Please remember that, unless otherwise stated, any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information in these areas. Do not use these areas to post personal information about third parties or discuss information about specific, identifiable patients.
